Enyuka Acceptable Usage Policy
Enyuka’s services may only be used for lawful purposes and activities.
Enyuka is proud of its reputation as an ethical and legally compliant Internet Service Provider, and as such complies with all relevant legislation including, but not necessarily limited to; the Consumer Affairs (Unfair Business Practices) Act, the Promotion of Access to Information Act, the Regulation of Interception of Communications and Provision of Communication-related Information Act, the Telecommunication Act and the Films and Publications Act.
In addition to the above, Enyuka is a proud and active member of the Internet Service Providers Association of SA (www.ispa.org.za).
Should you believe that we are not complying with any requirements of any act or any requirement of ISPA’s Code of Conduct, please contact us on complaints@enyuka.co.za Should your complaint not be handled to your satisfaction you may follow the Complaints Procedure on ISPA’s website (www.ispa.org.za).
Any activity that threatens the functioning, security and / or integrity of Enyuka’s network, or that brings Enyuka into disrepute is prohibited. Enyuka has no control over the content passing over the Internet and cannot be held liable, directly or indirectly, for consequential losses resulting from the use of its services. Including any email lost as a result of any Anti-Virus or Anti-Spam software solutions employed by Enyuka.
Enyuka considers the privacy and confidentiality of our Customers of paramount importance and, as such, will not share any customer information with any third party unless required to by law or, for the purpose of debt collection or, with the specific written consent of the Customer.
Enyuka General Terms and conditions
Both Parties accept their Physical Address as Domicilium Citandi et Executandi for any purposes relating to agreements.
The Customer accepts the Jurisdiction of the Magistrates Court of Johannesburg for all matters resulting from a dispute in terms of this agreement.
Payments due in terms of this agreement are payable monthly in advance.
Enyuka shall be entitled to suspend any or all services supplied in terms of this agreement, without notice, should any amount due on the Customers account be outstanding for 7 days or more or should any amount be returned unpaid by the Customer’s bank for any reason whatsoever.
Should any account be outstanding for more than 30 days the Customer shall be liable for the full value of this agreement, any legal expenses incurred by Enyuka on an Attorney Client Scale and Interest at a rate of FNB’s Prime Interest Plus 2%.
Enyuka will email the Customer’s Invoices to the Email Address listed as the ‘Primary Email’ above.
Should the Customer elect not to use the Debit Order Facility offered by Enyuka, the Customer agrees to pay all amounts due in terms on this agreement by the 7th day of the month in which the invoice becomes due.
Enyuka may, from time to time, increase the charges on this agreement provided that Enyuka provides the customer with a calendar month’s notice of the increase.
Charges in terms of this agreement, unless otherwise stated, are exclusive of Value Added Tax.
Agreements that commences on the Billing Start Date and continues indefinitely until either party gives the other party a calendar month’s notice of cancellation or as per the terms and timeframes of agreement.

Enyuka in terms of section 75 of the ECT Act, Enyuka has designated ISPA as an agent to receive notifications of infrigements, as defined in section 77 of the Act.
Terms Specific to Leased Line Services:
Enyuka shall liase with the PSTN Operator should any fault occur on a data line.
Enyuka shall not be liable for any losses, direct or consequential, due to the failure of PSTN Operator lines.
Where Enyuka pays for PSTN Services on behalf of a client, Enyuka shall be entitled to increase the charges billed for PSTN Services should the PSTN Operator Increase their charges at any time.
Terms Specific to Equipment Rentals:
The Customer accepts liability for the Insurance of all rental Equipment installed at their premises against Theft, Malicious Damage, and Acts of Nature at the Replacement Value shown on this agreement.
Should the Customer’s Insurance Company refuse to settle any claim, for any reason whatsoever, the Customer accepts Liability for the cost of the equipment.
The Insurance Value is deemed to include software installed on Rental Servers and the supply, configuration and installation of replacement equipment but specifically excludes travel and data-restoration costs.
The cost of Equipment Rental includes on-site maintenance during normal office hours but specifically excludes travel charges to site and after hours work.
The Customer shall only use the Rental Equipment in the manner, and for the purpose, it was supplied. Furthermore, the Customer shall not permit any person, other than Staff of Enyuka, to maintain, modify or interfere with the Rental Equipment.
The Customer shall have no claim or right against Enyuka in respect of, or arising from the use, possession, or failure of, or damage caused by the equipment.
Where this agreement includes the design of a Website, Enyuka retains copyright on the website design.
